This Website is operated by Artfolk. Throughout the site, the terms “we”, “us” and “our” refer to Artfolk. Artfolk offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. 

Any new features or tools which are added to the current Website shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. 

PURCHASES THROUGH THIS WEBSITE

Artfolk offers and sells through this Website: www.arfolk.com.au. All currency and purchase transactions will be performed in Australian Dollars. Artfolk reserves the right to change pricing at any time. We accept the payment methods of Credit Card via Stripe.

REFUND / RESCHEDULE POLICY

Artwork Purchases
Photography of paintings on the website are an indication of colour/framing only. Due to the nature of materials, lighting, furniture sizing/scale and room contents, colours and finishes may be different in your home/space.

All artwork sales are final. No change-of-mind, exchanges or refunds are permitted.

FREE Australian shipping is included with all artwork purchases, using Australia Post for works up to 1mx1m, or via courier.

Damages and issues
Please inspect your order upon receiving it and contact us immediately if the item is defective or damaged. Photography of any damage to packaging and contents needs to be emailed to vanessa@artfolk.com.au within 24hours of receipt of collection so that a complaint can be raised with the freight company. Artfolk will contact you of the outcome within 10 working days of your initial report.

Gift Vouchers
Gift vouchers are valid for 12 months and are redeemable for artworks listed on the Artfolk website only. The full amount of the voucher is to be redeemed in a single transaction, against a single or multiple works.

Workshop Bookings
Rescheduling is permitted up to 7 days prior to the booked event. When rescheduling, the customer must choose the next most convenient session date that is available and advise Artfolk ASAP via email.

Artfolk is very strict on ‘no shows’. If a customer does not show up for the class, the full cost of the workshop will be charged/kept. We are unable to refund, reschedule or provide credit for a missed session.


firing of ceramics

All clay workshops include firing costs with works fired to make them food safe and/or durable. Artfolk is not responsible for surface and glaze cracking, bulging, viscosity, pinholing, shearing or blowing up of works during the handling and firing process.

Artfolk will make Artfolk Original Workshop ceramic works available for collection from any workshop at the Woolloongabba Substation in the first month after firing, upon an initial email notification sent from vanessa@artfolk.com.au. After this time works can be collected from the Carindale studio upon booking a date/time.

Artfolk will hold works for a maximum of 3 months. Any unclaimed works remaining beyond this time will be gifted to good will stores. Attendees are to advise ASAP if they do not intend to collect/keep their work.


Private Functions

Private Function deposits are non-refundable. If the full amount has been paid and there is more than 2 weeks before the session date, we can reschedule your private function to another date that is suitable for yourself and Artfolk. We are unable to refund or reschedule private functions within the 2 weeks before your session date. The full amount will be forfeited. 

CANCELLATIONS BY ARTFOLK

In the event a workshop is cancelled by Artfolk, the ticket purchaser will be notified via email or text message no later than 24 hours prior to their session scheduled start time. Ticket purchasers will be offered a reschedule to another upcoming session or credited the value of their purchase for future use.

GIFT VOUCHERS

Gift Vouchers are non-refundable and can only be used prior to their expiry date only against ‘Artfolk Original’ workshops and not those held at third party venues where Artfolk does not collect monies. 

BOOKING CONFIRMATION

Upon purchase, your booking will be submitted to Artfolk for processing. You will receive a confirmation email describing the date, time, ticket quantity, and cost of your booking. This email confirmation of your order will be taken as proof of your acceptance of the provisions contained in these Terms and Conditions, the Privacy Policy, and the data recorded by Artfolk on its server shall be treated as legal evidence of the transaction between Artfolk and the Purchaser.

COMPETITIONS AND PROMOTIONAL OFFERS

Artfolk may use the Website to run competitions and other promotional offers. You acknowledge that by participating in such competitions and promotional offers, you have read and agree to be bound by any additional terms and conditions applicable to those competitions and promotional offers and you have consented to use of your personal information in accordance with those terms and conditions and the Artfolk Privacy Policy may be amended from time to time.

COPYRIGHT

All artwork, paintings, photos, graphics, text, audio clips, button icons, slogans, trade names and other intellectual property contained on our website, belongs exclusively to Artfolk. You may not use, reproduce, modify, copy, transmit, display, publish, sell, license, distribute or commercially exploit any of the content or otherwise dispose of any of the content in a way not permitted by us, without our express written consent.

CONDITIONS OF ENTRY

COVID-19

During the COVID-19 pandemic, Artfolk are taking all necessary precautions outlined by the state government. Artfolk reserves the right to refuse entry or ask guests to leave a venue if they do not reasonably follow the below. We ask that guests assist in this by:

Practicing social distancing of 1.5m between others

Washing and sanitising hands

Staying home if unwell or showing signs of the virus

Staying home if tested positive or are awaiting test results


RESPECT

Follow guidance of staff and refrain from speaking over workshop instructions, hindering the experience for other guests. Customers must respect the staff and may be refused entry or asked to leave the premises if they do not follow such terms.

PERSONAL BELONGINGS

Artfolk does not accept responsibility for any losses or damage incurred to personal belongings or clothing. Guests should dress appropriately to the activity.

ARTFOLK/VENUE PROPERTY

Guests should not cause damage to any property owned by Artfolk or venues. All materials and tools provided by Artfolk remain the property of Artfolk and are not to be removed from the workshop space or venue.
Any person who intentionally damages property without lawful excuse, whether it is public, private or commercial property, may be charged with the offence of willful damage. Governed by section 469 of the Criminal Code 1899, many actions constitute willful damage, and with this comes varying penalties.

ALCOHOL

Artfolk is not responsible for the supply or consumption of alcohol. It is illegal for a person to supply liquor and for a minor to drink liquor in a BYO venue. Artfolk prohibits underage drinking.

SMOKING

All Artfolk workshop venues are strictly smoke-free and smoking is not permitted under any circumstances.

PHOTOGRAPHY

Artfolk may take promotional photos or videos during a public or private event. Customers have the right to decline to have their images captured and should make this known to the staff members. Customers should also avoid taking photographs and videos of other guests, unless permission is given. No images are to be captured of minors, unless permission is granted by the parent or guardian.

DISCLAIMER AND LIMITATION OF LIABILITY

The Purchaser agrees that the provision of any service, including but not limited to public art sessions, purchased from our website is at the Purchaser’s sole risk. To the full extent permissible by applicable law, Artfolk will not be liable for any damages of any kind arising from the use of this site, or from any services provided from this website or establishment, including but not limited to direct, indirect, incidental, punitive, and consequential damages. No oral advice or written information given by Artfolk nor its affiliates, nor any of their offices’ directors, employees, agents, providers, or the like, shall create a warranty or legal obligation; nor shall the Purchaser rely on any such information or advice.

ARTFOLK PRIVACY POLICY

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.artfolk.com.au (the “Website”).

We may revise this Privacy Policy updating this page. The revised Privacy Policy will take effect when it is posted on our website. We refer throughout this Privacy Policy to ‘personal information’ which means information which identifies you as an individual or from which you can reasonably be identified i.e your name, email, address and telephone numbers.

We are subject to the requirements of the Privacy Act 1988.

We may collect your personal information when you make a transaction, contact us, enter a competition, complete a survey, or join a mailing list.

We also use your personal information to send you marketing, promotional and market research material about products and services which we think are likely to be of interest to you and/or to identify services and products that may be of interest to you.

In doing so, we may contact you by email, SMS, post or phone or via our website and we may also use internet-based and/or social media marketing channels including targeted online advertising and online behavioural marketing. Our marketing agencies and service providers may also use your personal information in order to serve you with more relevant advertising about our Services or the products and services of our clients, suppliers and rewards program partners.

For example, access to your personal information is restricted within Artfolk to employees who have specific authorisation to access such information.

We continually endeavour to improve our security safeguards. However, no data transmission over the internet is guaranteed to be perfectly secure, so we cannot absolutely promise that the information you provide to us (or other information we collect or transmit) using the internet will always be totally secure.

We provide links to websites that are owned and/or operated by third parties. Unless otherwise stated at those websites, those websites are not under our control, and we are not responsible for the conduct of companies linked to our website. Before disclosing your personal information on any other website, we advise you to examine the terms and conditions of those websites.
